Terms and Conditions
Agreement
Veronika Zii Photography and the Client hereby acknowledge that the following Standard Terms and Conditions are incorporated in and make a part of the Agreement between the parties hereto.
Photography Engagement and Services
The Agreement is between Veronika Zii Photography and the Client named on the contract. The Client wishes to engage Veronika Zii Photography and Veronika Zii Photography accepts the engagement assignment to hereby:
(a) provide the Services to the Client; and
(b) produce Digital Photographs/images supplied in an online gallery.
Contract and Payment Arrangements
An electronically signed photography contract and full payment are required to secure your bookings/job. These Terms and Conditions may be varied at any time, with or without notice to you, at our sole discretion. However, once a contract has been entered, the Terms and Conditions stated within the contract will remain.
The Client agrees to pay Veronika Zii Photography. Any additional costs such as permits to photograph in national parks or on beaches that require permits, if any, are the responsibility of and must be paid for by the Client.
Cancellations
Due to the nature of the services, full refunds are not available once photos have been taken or logos have been designed. If you change your mind or decide not to go ahead with a photography shoot, another date will be scheduled accordingly, so long as sufficient notice of cancellation no less than 1 week before the booking, has been given to Veronika Zii Photography in writing.
If another date is not available and one week's notice has been given, Veronika Zii Photography will issue a 50% refund.
If another date is not available and more than 2 week's notice has been provided, Veronika Zii Photography will issue a full refund.
Force Majeure Clause
Veronika Zii Photography is not responsible for any failure to perform any obligation under these T&Cs if its performance has become impossible due to any matter beyond the reasonable control of Veronika Zii Photography which includes (but is not limited to); fire; flood; tempest; earthquake; riot; civil disturbance; natural disasters; national emergencies; pandemic; government interference; theft; crime; strike; lockout; breakdown; war; or the inability of the Veronika Zii Photography's normal suppliers to supply necessary matter beyond the reasonable control of Veronika Zii Photography. In such circumstances, Veronika Zii Photography will be under no obligation to refund any monies paid.
Schedules
Veronika Zii Photography will provide a schedule for the time that the client has booked. The schedule will include all known times for each component. It is the responsibility of the client to inform Veronika Zii Photography of any changes or additions made to the schedule no less than 7 days before the booking date. Veronika Zii Photography is not responsible for any omissions to the schedule that result in us not being able to carry out our duties. Veronika Zii Photography will not be held responsible for any lack of photographs delivered due to unknown changes or omissions.
Limitations from Venues
Please note that Veronika Zii Photography is governed by the restrictions imposed by churches and venues. In some cases, venues restrict the movement of photographers, the use of flash or in extreme cases prevent the taking of photographs at all. It is the responsibility of the Client to inform themselves of these restrictions and inform Veronika Zii Photography before the booking date. Veronika Zii Photography will not be held responsible for any lack of photographs delivered due to these restrictions.
Copyright
Copyright in the photographs and ownership of the original digital (RAW) image files is retained by Veronika Zii Photography. The Client is granted a perpetual and irrevocable non-exclusive, royalty-free licence to use images for private, domestic and personal use only. Any sale or commercial use must have prior written approval by Veronika Zii Photography. Veronika Zii Photography asserts all moral rights attached to the Photographs and the Client does NOT have the right to edit, change, add to, take from, alter or otherwise amend the Photographs without the prior written consent of Veronika Zii Photography except in the case of cropping an image. The Client may submit images to their other vendors for social media use only or to sections of websites, magazines, and blogs, however, a credit to Veronika Zii Photography as the photographer must be given in the form of either a social media handle or direct website link. Image Style & Editing Process
The Client acknowledges that they are familiar with our style and that our work is continually evolving and are of a unique and artistic nature, that the photos taken may be different from those taken in the past and that Veronika Zii Photography will use their expertise and artistic judgement to create images consistent with their vision, which may be different from the Clients. Our editing encompasses colour grading of all selected images for the client in Lightroom and retouching/removing distractions in Photoshop if required at the photographer's discretion. Our prices do not include requested edits from the Client. Additional editing may be requested and a fee per image will be quoted upon request and must be accepted before any work is to be carried out.
Image Use (Optional)
Veronika Zii Photography may use the photographs for advertising or otherwise promoting it's business and work. This is optional and the Client must inform Veronika Zii Photography in writing if they do not wish to have their images used in any advertising or promotion.
Image Storage
Veronika Zii Photography will provide you with an online gallery of your images which you will be able to access for up to 6 months from when the gallery was made available. After this period, if you wish to keep your gallery you will need to apply for a gallery subscription. Veronika Zii Photography is not responsible for images lost due to expired galleries. If you cancel your gallery subscription, you will no longer be able to view your gallery. Veronika Zii Photography is not responsible for any lost images due to terminating a subscription.
Delivery
All Clients will be provided with an online gallery where images can be downloaded and/or purchased via an online printing vendor. At no stage will RAW files be delivered. Online galleries will be uploaded within 1-2 weeks of the booking date excluding public holidays. Delivery times for items purchased within the gallery are determined by the printing vendor. It is the responsibility of the Client to contact the printing vendor in regards to location/delivery time and/or other matters.
Attendance
In the unlikely event, Veronika Zii Photography is unable to complete the coverage due to unforeseen circumstances such as illness, serious injury or death; we will work together to find an alternate professional photographer to cover your day complete the assignment.
Loss or Damage
Veronika Zii Photography shall carry out this assignment with due skill, care and professional diligence. Elements that are beyond our control include interruption of our service due to interference by guests, other photographers or, faulty material, equipment failure or damage or loss of digital files. In the case of digital file loss, Veronika Zii Photography and the Client agree that the liability of Veronika Zii Photography shall be limited to a full or partial refund of any money paid under this agreement, which shall be in full & final satisfaction of any damage or loss suffered.
Coverage
Every effort will be made to capture as many moments as possible. It is not always possible to capture absolutely everything. If you have suggestions or desires for photos to be captured such as a surprise dance down the aisle or a set photo of the groom and his mum, please write them down on a list for me and I will do my best to get them. Due to the ever-changing nature of events, not everything can be covered. Veronika Zii Photography is not responsible for images missing, absent family member(s) during the assignment/family photo session.
Guest/Client Cooperation
The Client is responsible for the conduct of themselves and their guests. Veronika Zii Photography will not tolerate verbal or physical abuse. If the Client is unable to control themselves and/or the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer, it will result in the early or immediate departure of the photographer. The Client understands that in such an event, no refunds will be granted.
